The terms that govern use of this website and Threvol Technologies LLC services.
1. Acceptance of Terms
By accessing or using the website threvoltechnologies.com (the "Site") or submitting any inquiry or order, you ("you" or "Client") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site or submit any forms.
These Terms apply to use of the Site and to any preliminary service conversations or order submissions made through the Site. Actual managed service engagements are governed by a separate Master Services Agreement ("MSA") executed between Threvol Technologies LLC and the Client.
2. About Threvol Technologies LLC
Threvol Technologies LLC is a Delaware limited liability company with operations throughout the United States, providing managed cybersecurity, infrastructure observability and business resilience services. Our services are directed to business entities and their authorized representatives. We do not provide consumer services.
3. Site Use and Eligibility
You must be at least 18 years of age and authorized to act on behalf of a business entity to use the service inquiry, assessment and order features of the Site. The Site is intended for business-to-business use only.
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law or regulation
- Submit false, misleading or fraudulent information through any form
- Attempt to gain unauthorized access to any part of the Site or its systems
- Interfere with or disrupt the integrity or performance of the Site
- Use automated tools to scrape, crawl or extract data from the Site without our written consent
4. Service Descriptions and Pricing
Service descriptions and pricing displayed on the Site (including the Plans page) are for informational purposes only. All prices are shown in United States Dollars (USD).
Starting prices are planning references, not automatic quotes. Final pricing for any service engagement is confirmed only after an authorized Threvol representative reviews your environment, capacity, coverage requirements and executes a written service agreement.
The "Business Resilience Score" and related metrics referenced on the Site are proprietary assessment frameworks developed by Threvol Technologies LLC. They represent our internal methodology and are not certified by any external regulatory or standards body.
5. Order Submissions (Basic Plan)
Submission of a Basic service order through the Site constitutes an expression of interest only and does not create a binding service contract. A service contract is formed only upon execution of a written Master Services Agreement signed by authorized representatives of both parties.
By submitting an order form, you confirm that:
- You are authorized to make purchasing decisions for your organization
- The information you provide is accurate and complete
- You have reviewed and understood the service scope described in the order flow
- You consent to Threvol contacting you by email or phone to discuss the service request
6. Intellectual Property
All content on the Site — including text, graphics, logos, service names, frameworks, assessment methodologies and software — is the property of Threvol Technologies LLC or its licensors and is protected by United States copyright, trademark and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display or exploit any content from the Site without our prior written consent.
7. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF INFORMATION.
Threvol Technologies LLC does not warrant that the Site will be uninterrupted, error-free or free of viruses or other harmful components. Cybersecurity services, by their nature, cannot guarantee the complete prevention of security incidents.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THREVOL TECHNOLOGIES LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR SUBMISSION OF INFORMATION THROUGH THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF USE OF THE SITE (EXCLUDING CLAIMS ARISING UNDER A SEPARATE SERVICE AGREEMENT) SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).
9. Indemnification
You agree to indemnify, defend and hold harmless Threvol Technologies LLC and its members, officers, employees, agents and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.
10. Third-Party Services
The Site uses FormSubmit.co to process and deliver contact form submissions. By submitting a form, you acknowledge that your submission data is processed by this third-party service. We are not responsible for the practices of third-party services.
11. Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to the personal jurisdiction of such courts.
For disputes involving amounts under $5,000 USD, the parties agree to first attempt resolution through good-faith written negotiation before initiating any legal proceeding.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. We will post the revised Terms on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Threvol Technologies LLC regarding use of the Site and supersede all prior agreements relating to the same subject matter. They do not supersede or modify any separately executed Master Services Agreement.
